Terms of Use

The owner of the online store birdbusters.eu (hereinafter referred to as the online store) is Salu OÜ ( registry code 12600389), located at Kunderi 27-10, Tallinn, Estonia (hereinafter referred to as the Seller).

GENERAL

The conditions of sale apply to purchases of goods from the online store.

By accepting the Terms of Use, the Buyer confirms that he has read the Terms of Use and accepts them.

In addition to the Terms of Use, the relevant legislation of the Republic of Estonia and of the European Union apply.

All material on the Seller’s website is protected by copyright. Unauthorised copying and use without the written permission of the Seller is prohibited.

The Seller reserves the right to change the Terms of Use.

PRODUCT AND PRICE INFORMATION

All prices are in Euros. The shipping fee is calculated and added at checkout.

Shipping fees vary based on your location and chosen shipping method. The shipping cost is displayed at checkout.

Prices include applicable VAT. Buyers outside the EU may face import duties and taxes, payable by the buyer.

The seller is not responsible for customs charges. Refusing a package may incur a fee deducted from your refund.

Product details are listed next to each item online. For more information, please contact the customer support.

Actual product colours may vary due to display settings.

The Seller reserves the right to adjust prices. The terms and prices valid at the time of the transaction are applied.

PLACING AN ORDER AND CONTRACT OF SALE

Add items to your cart and choose a shipping method to see the total cost. Fill in the required details.

You can make changes in products and quantities in the shopping cart.

Before making a purchase, please make sure that the selected products and quantities are correct.

Ensure your checkout information is correct. Mistakes may cause delays and extra costs for the customer. Contact us immediately if you find an error.

Items in the cart are not reserved until the payment is made. Make sure to complete your payment to confirm your order.

The order confirmation is sent via email. Please note that emails associated with your order may automatically go to the spam or promotions folder. If no confirmation e-mail is received within 20-30 minutes, please contact us either by e-mail info@birdbusters.eu or by calling +3725267138.  Customer support is provided in Estonian, English and Russian.

The sales contract enters into force once payment is received.

Credit card payments are made in the secure external environment of Stripe. We don’t see your credit card info.

Direct bank payments can be made through the following banks:

  • Estonia: LHV, SEB and Swedbank
  • Latvia: Swedbank, SEB, Citadele and Luminor
  • Lithuania: Swedbank, SEB and Luminor
  • Finland: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki

PLEASE NOTE! After paying by payment link, make sure to click on “Return to merchant” on the bank’s website.

Payments can also be made via PayPal.

We kindly ask for your understanding in case of stock errors. If a product is out of stock after payment, we’ll let you choose from:

  • We will send the product when it is restocked (informing you about the new estimated delivery time);
  • A full refund.

If your order cannot be delivered, we will notify you as soon as possible and refund all costs immediately, but no later than within 14 days.

SHIPPING

Goods are shipped worldwide. Please check the available countries in the Shopping Cart. If your country isn’t listed, contact us and we will add your country if possible.

Goods are delivered to parcel terminals or by a courier. The shipping options are displayed after choosing the destination country and entering the address at checkout.

The purchaser pays for the shipping and the price information is displayed next to the shipping method.

Delivery times vary by country and delivery method. Orders in Estonia, Finland, Latvia, and Lithuania generally take 3–10 business days from the date of entry into force of the contract of sale. Orders to all European countries are guaranteed to arrive within 18 business days, and orders to countries outside the European Union take up to 5 weeks to arrive.

Delivery times may be longer during busy periods like Christmas and Black Friday.

We are not responsible for delivery delays caused by unforeseen issues.

Availability of the product in our warehouse may also affect the delivery time. We have the right to ship goods in up to 45 calendar days in exceptional cases.

We will notify you of any delays we are aware of. If your order hasn’t arrived by the expected date, contact us at info@birdbusters.eu.

Neither the online shop nor the courier company are liable for any delays in the delivery of the products and for any misunderstandings if such delays or misunderstandings are caused by the buyer providing inaccurate or incorrect data upon checkout of the order.

All orders are shipped from the European Union.

RETURN POLICY

14-Day Return: You can cancel your order and return the products within 14 days of delivery. The countdown starts when you or a third party you choose (not the delivery service) receives the products. Remember to send the items back or show proof of return within this period.

Conditions of Returns:

Items must be returned in their original packaging with all labels attached. If a price tag or packaging is damaged, reasonable exceptions apply. However, items that have been used cannot be returned.

In the event that a package appears damaged upon receipt, the recipient is required to take clear photographs of the package before opening it. These photos must visibly show the damage to the exterior of the package. The recipient should then send the images, along with their order number and a brief description of the damage, to our customer service team at info@birdbusters.eu as soon as possible. Failure to document the condition of the package prior to opening may affect the eligibility for a refund or replacement.

To exercise the 14-day right of return/ withdrawal, items must not be used in ways beyond necessary to ensure the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in a physical store.

Visible wear and tear or misuse may lead to refusal of return or to lower returned amount in accordance with the decreased value of the goods.

Businesses/ legal entities are exempt from returns.

How to Return: Submit a return request via email info@birdbusters.eu within 14 days of receipt of the goods at the latest.

Return Costs: You’ll need to cover return shipping unless the reason for the return is non-compliance with the order or the item is incorrect or faulty.

Responsibility: You are responsible for the item until it safely reaches us. Ensure it is well-packed to avoid damage during shipping.

Refunds: Refunds are processed as soon as possible but no later than within 14 days after receiving the returned goods. A refund will be made to the same account from which the payment was made.

Full order returns include delivery costs.

In case of partial return, shipping fees will not be refunded.

The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.

If the buyer has chosen a different form of shipping than the cheapest usual method of shipping offered by the online store, the store is not required to compensate the cost exceeding the usual shipping cost.

The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.

The online shop will not assume liability for any potential damages caused to the buyer due to technical issues (problems in using the online shop), including for delayed delivery of a product ordered. Here, technical issues are construed as technical issues independent of the seller, such as interruptions in internet connection, server failures, etc.

RIGHT TO MAKE A CLAIM

The online store is responsible for the non-compliance of goods sold or for deficiencies which were present at the time of delivery and which occur within two years.

We assume any defects noticed within six months were there from delivery and if in doubt, we have the obligation to prove otherwise.

The purchaser must report defects within two months of the occurrence.

We are not responsible for damages due to the fault or negligence of the buyer, for misuse of the product, or for the natural wear and tear during normal use.

If goods bought from the online store have defects for which we are responsible, we will repair or replace the defective goods. If the goods cannot be repaired or replaced, we will refund the defective goods.

We will reply to your complaint in writing within 15 days.

To report a defect, a corresponding application must be submitted to the e-mail info@birdbusters.eu. The application must include:

  • Name and contact information
  • Date of Complaint
  • Description of the defect
  • Order number
  • Photos of the defect.

DIRECT MARKETING AND PROCESSING OF PERSONAL DATA

The privacy and security of customer data is important to us. We treat all personal data that has become known in connection with visiting the online store and making a purchase as confidential information.

We only transfer personal data to third parties for the delivery of the order and in other cases required by law.

We only use the personal data entered for processing the order and delivery. We forward personal data to the transport service provider in order to deliver the goods.

SETTLEMENT OF DISPUTES

All complaints made by a purchaser about the online store must be e-mailed to info@birdbuster.eu.

If the purchaser and the online store are unable to settle the dispute by agreement, the purchaser may apply to the competent supervisory authority, which is the Consumer Protection and Technical Regulatory Authority at Endla 10a, Tallinn 10122, e-mail: info@ttja.ee.  The Consumer Disputes Committee is competent to resolve disputes arising from a contract between a purchaser and a trader which the parties have not been able to settle by agreement and where the value of the disputed goods or services is 20 EUR or more. The review of the buyer’s complaint in the committee is free of charge.

Consumers can also use the Online Dispute Resolution (ODR) environment available across the European Union to resolve disputes.
